The newly revised C.A.R. Residential Purchase Agreement (RPA) released in December 2021 contained some significant changes to the items included and excluded in a sale.
Optional items are now set forth in paragraph 3P of the new “Grid” on page 3 of the RPA. Bathroom mirrors, however, are listed as included in the sale through the use of a pre-checked checkbox (unless otherwise excluded). The other boilerplate items included or excluded in a sale are separately set forth in paragraph 9 on pages 6 and 7 of the RPA.
For your ease of reference, we have created a 2-page list of the included, excluded, and optional items under the revised RPA, available here.
Additionally, the revised RPA now provides that items that the seller does not remove from the property upon the buyer’s possession shall be deemed abandoned (paragraph 7B(1)). The RPA also allows the buyer to remove or dispose of such items after first delivering to the seller a 3-day written notice. The 3-day notice is called the “Demand to Remove Personal Property and Debris” (Form BDRPP). It is available in the “CAR Sample Letters” Forms Library in zipForms, not the regular C.A.R. Forms Library. The acronym for the “CAR Sample Letters” Forms Library in zipForms is CARSL, not CAR.
